When Can A Minor Move Out

In most states, the age at which you can move out without permission from your parents is 18-years-old. There are some states which may let you move out without permission at 17, but they are very few.

Here is more about specific states and comments:

  • TEXAS: You can move out at 17.

  • GEORGIA: OCGA 19-7-1. (a) Until he reaches the age of majority, the child shall remain under the control of his parents, who are entitled to his services and the proceeds of his labor. In the event that a court has awarded custody of the child to one parent, only the parent who has custody of the child is entitled to his services and the proceeds of his labor.

OCGA 19-7-2. It is the joint and several duty of each parent to provide for the maintenance, protection, and education of his or her child until the child reaches the age of majority, dies, marries, or becomes emancipated, whichever first occurs, except as otherwise authorized and ordered pursuant to subsection (e) of Code Section 19-6-15 and except to the extent that the duty of the parents is otherwise or further defined by court order.

The age of majority is 18 in Georgia. As the above code section clearly states a child (who is any one under the age of 18) cannot just move out from their parent(s) home. The parent(s) are responsible for the child till that child reaches 18.

Exceptions to this rule: If a child gets pregnant, that child can get married without parental consent and after the marriage will be consider emancipated. The teen can become emancipated which requires a ruling from a judge and in the state of Georgia on an annual basis this happens about a dozen times. The teen can join the military with parental consent at age 17. These are the only exceptions to the above code sections.

Those children who choose to run a way from home and claim they can, the parents can get a warrant for the Childs return which requires the child to be classified as a delinquent and then the child will be subjected to the juvenile justice system.

  • LOUISIANA: The age of majority in LA is 18. Additionally, emancipation by Notarial Act, appears to be a very simple process for those who are younger.

  • With exception of four states the legal age of majority is 18, in Alabama and Nebraska it is 19, and in Mississippi and Pennsylvania it is 21. Most states have exceptions to the age laws, such as marriage and enlistment in the military, both of which require the consent of the parent(s) or legal guardian.

  • Unless you are legally emancipated (a judge rules that you are no longer a dependent of your parents), I think you need to be 18 before you can move out.

  • An action such as a minor requesting with whom they want to live and being granted said request is not the prescribed procedure in the U.S. In a very few states a minor who is at least 16-years of age can petition for emancipation rights. There is, however a misconception that every minor who files will be granted an emancipation decree, the reality is, it seldom happens. That aside, a minor in the U.S. does not arbitrarily decide where or with whom they choose to live. Such issues are decided by a judge after prescribed due process has been followed.
  • Any age, but you're not a legal adult until the age of 18, so until then the police would bring you back home. Incidentally, most runaways end up caught in drug use, prostitution, crime or homelessness, so you may want to assess your situation and determine whether running away is really a good option.

  • A minor cannot live with a "significant other" w/o the parent's permission. Even then juvenile authorities could intervene if objections were made by an outside party. If the person is a victim of physical or emotional abuse he/she should contact DFS (state social services) for assistance. If the person feels they are in immediate danger they should contact the local police department. An investigation will be done, if circumstances warrant the removal of the minor from the home, she/he will be held in protective custody (not jail) until the court hearing. At that time the judge will review any evidence and hear testimony from all concerned parties before making a determination. The minor child might be returned to parental custody, be appointed a guardian, be placed in a foster home or other type of state supervised living facility.

  • It should be noted that emancipation can be accomplished at age 18 in most states and can be court ordered anytime after the age of 12 depending on circumstances. These circumstances are governed by State Law and you need an attorney to represent the child that is licenced in the state of residence.
