Depends on the State...
I beleive it is unilaterally a felony crime for any felon to possess a firearm. Any felony conviction means the possility of incarceration of a minimum of one year in jail.
Because of the prior felony conviction, that person has "lost the presumption of innocence" in the courts eyes. An arrest for another felony crime will be pursued.
