In Texas, if an adult engages in sexual conduct with a minor, with ot without consent, they have committed sexual assault. An affirmative defense to prosecution is they are not seperated by more than three years of age.
At times, the minors parents choose not to press charges; however, this does not prevent the state from acting as the complainant and pressing charges.
